Disability Retirement (SSDI)

The Social Security Administration provides for disability benefits to people who are unable to work because they suffer from a medical condition that is expected to last at least one year or result in death. This program has very specific definitions of disabilities. A a result, the process for application can be daunting.

Because an applicant must suffer from a condition that is either permanent or long term, the Social Security System does not provide for any type of short term disability.

In addition to claimant benefits, disability benefits may be paid to an applicant’s family. Members of the applicant’s family may be eligible for payments under the following circumstances:

• Applicant’s spouse, if he or she is 62 or older;
• Applicant’s spouse, at any age if he or she is caring for a child who is younger than age 16 or disabled;
• Applicant’s unmarried child, including an adopted child, or, in some cases, a stepchild or grandchild. The child must be younger than age 18 or younger than 19 if in elementary or secondary school full time; and
• Applicant’s unmarried child, age 18 or older, if he or she has a disability that started before age 22.

In order to be eligible to receive disability benefits, an applicant must have worked a certain amount of time. This amount depends on the applicant’s age. For instance, a 25 year old may be eligible if he or she worked 1.5 years prior to becoming disabled. On the other hand, a 50 year old will need to have worked at least 7 years before becoming disabled.

The application process can take many months. If an application is denied, it can take more than a year to have your case heard before an administrative judge.
